ANNEX to the Contract: TERMS and CONDITIONS for tourist guide services and sports equipment rentals
1. Generalities:
The customer represents the person who, after reserving a place, benefits from the services, activities and utilities that the company and its representatives provide or offer for rent. All clients participating in guided tours as well as those who rent and use sports equipment, benefit from training and demonstrations by ETTA Mundo representatives for the safe use of the equipment and the safe conduct of the guided tour.
The client assumes on his own responsibility that he is physically fit to carry out the activity he signed up for and does not have any illness/diseases that would put him in danger during the activity, he being fully responsible, including the administration of any medical treatment. It is forbidden and not recommended to consume alcohol, drugs or narcotic/hallucinogenic substances during the activities.
Pets will be accepted only when the organizer decides based on the information held that the integrity and safety of both the animal and the group cannot be affected. If it is found that the health/physical condition of any participant/user is not one optimum in order to carry out the activity, as well as in case it is found that the age of any participant/user is not suitable for carrying out the activity, the representatives of ETTA Mundo will order the non-participation of the person in the activities where his presence is impossible and the price paid will not be give back.
If the participant’s physical condition is not optimal as a result of his direct actions (consumption of alcohol, narcotic substances, drugs etc.), ETTA Mundo reserves the right to terminate the contract at the time of detection of violations, the price paid by/for the respective user will not be reimbursed and all expenses caused by this termination of the contract will be fully and directly borne by the person who was excluded/his representative/the signatory of the terminated contract.
In the event that during the activity/tour, the participant/user does not respect the instructions, rules, terms and conditions that have been made known to him, or through his actions causes discomfort or endangers the other participants, ETTA Mundo reserves the right to terminate the contract at the time of detection of deviations, the price paid by/for the respective user will not be refunded and all expenses caused by this termination of the contract will be fully and directly borne by the person who was excluded/the representative to it/the signatory of the terminated contract.
The refusal to wear the mandatory protective equipment related to each activity gives the ETTA Mundo association the right to terminate the contract at the time of detection of violations, the price paid by/for the respective user will not be refunded and all expenses caused by this termination of the contract will be borne in full and directly by the person who was excluded/his representative/the signatory of the terminated contract (eg: transport, accommodation, guide expenses, equipment expenses).
The request to return the goods rented before the date and time and/or in a different location than those established by the parties involves additional costs. In this case, the amounts paid under this contract are not refunded, and the Beneficiary will additionally bear all the previously mentioned costs, on the date of the occurrence of the event.
If the user/participant in the guided tour is a minor, he/she will be accompanied by a parent/legal representative/conventional representative and will present to ETTA Mundo the express consent of the parent/legal representative in order to use the equipment/carry out the activity for which the equipment is rented, as well as for the processing of personal data and their use, by the signing by these representatives of the Form for the processing of personal data and the Declaration on their own responsibility.
If you notice any danger or an accident, immediately alert ETTA Mundo representatives so that they can intervene as soon as possible. In extremely serious cases, call the emergency number 112.
2. Registration and Reservation
The reservations can be made by any direct or indirect verbal means. The reservations made in writing, or verbally, must be confirmed in writing without delay by ETTA Mundo. That person who makes a reservation for himself or for another party, by this fact is considered the principal, and if he does not declare otherwise, he will assume the responsibilities arising from the mandate, towards ETTA Mundo (payments, waiver to the contract etc.).
After receiving the reservation request for equipment rental and/or participation in the guided tour, the applicant will receive the contract and proforma invoice in order to pay the price. The price is paid in full within a maximum of days established by the organizer, from the moment of the reservation request, regardless of the communication channel through which the request was issued.
By paying the price, it is considered that the applicant has taken note of the Terms and Conditions of ETTA Mundo and agrees with them, any subsequent complaint not being taken into account. The reservation is considered valid only after full payment of the price.
In order to provide the services and fulfill the legal obligations imposed on ETTA Mundo by the legislation in force, the applicant and ETTA Mundo undertake to conclude the contract related to the requested services and its annexes (declaration on the applicant’s own responsibility, GDPR information sheet, takeover minutes equipment etc.), until the date set for the start of services.
The price paid will not be refunded in the following situations, any of them being considered a renunciation of the requested services by the applicant:
– non-payment of the price in full (advances paid are not returned, being kept by ETTA Mundo as interest);
– the applicant’s non-appearance at the date and time established by means of information sent at least 24 hours before the start of the event.
– withdrawal of the applicant less than 10 days before the date set for the start of the activity;
– the applicant’s refusal to sign the necessary documents for the provision of services (contract, GDPR information sheet, self-responsibility declaration, equipment handover report etc.);
– non-presentation of the documents requested and imposed on ETTA Mundo by the legislation in force regarding the protection rules against Sars Cov virus;
– the applicant’s refusal to participate in one or all of the reserved activities and/or to take over the equipment;
Considering that the provision of services requires the use of special logistics, this is done only under the conditions of meeting a minimum number of reservations, established by the organizer.
For justified reasons such as unfavorable weather conditions, the failure to meet a minimum number of people who reserve the equipment rental/participation in the guided tour, ETTA Mundo has the right to change the rental period unilaterally, notifying the change to the applicant no later than 2 days before the date established for the provision of services. If, following the notification, the applicant declares that he does not agree with this change, ETTA Mundo will return the amounts paid within 14 working days from the date of his notification in this regard.
3. Mandatory training and equipment
Mountain trails are classified according to several criteria, established at the international level. They depend on the duration, the season in which they can be completed without problems, the degree of difficulty and the necessary equipment for the hike.
The first thing to do is related to information. It is very important to carefully read the information sent by our team and then to listen carefully when the guide details the route and the safety rules before starting the route.
You have to plan the hike according to your physical condition and the mountain equipment you have. According to our instructions, your luggage must not be missing any item of the equipment that the guide recommended.
Technical details:
Equipment: depending on the difficulty of the chosen route, you will need ordinary, special trekking boots, technical clothes or complex sports equipment (collars, ice axe, helmet, harness etc.).
Duration: flat terrain or smooth slopes, 4 km/h; ascent on the path already made, 350 m/h, ascent on the rocky path, 250 m/h, descent on the smooth path, 450 m/h, descent on the path less beaten, 400 m/h.
Season: not all routes can be traveled in the same way in any season. For each one, you must be interested in which time of the year you can enjoy hiking without having difficulties. There are mountain routes that are closed in winter because they become particularly dangerous.
Degree of difficulty: easy (3-6 hours), difference in level of 200-600 m, low effort; medium (4-8 hours), the difference in level of 600-1,200 m, you can go through it with some effort, but without having to have trained seriously before; difficult (over 8 hours), the difference in level is over 1,200 m, the physical effort is very high and you have to prepare very well beforehand.
Before leaving for the road, think first of all about your safety and that of those accompanying you. The mountain is unpredictable, no matter how well you think you know it. The weather in mountainous areas can surprise you, even if you follow the forecast.
4. Rules of conduct
- always go to the mountains with appropriate equipment;
- don’t go on the mountain unless you are in a state of health suitable for the route. Do not overestimate your physical and mental resistance;
- the danger of getting lost is high, being advised not to leave the group;
- movement is done at the group’s pace;
- I recommend greeting the tourists you meet along the route.
- go constantly; don’t force the rhythm, don’t cut the serpentines; save your strength;
- you can go on the mountain in monom, especially in winter; avalanche zones are crossed individually so as not to create pressure on the snow;
- no alcohol is consumed during the activities;
- on the mountain there is no shouting, no unnecessary noise;
- respect the hut/refugee and the internal order regulations;
- throw garbage only in specially arranged places;
- do not damage signs with tourist markings or other orientation signs;
- light the fire only in specially arranged places. supervise it and turn it off completely at the end;
- don’t dig a ditch around the tent!;
- don’t pluck the flowers, don’t scratch the trees, don’t crush insects or mushrooms, even poisonous ones; each element in nature has its role; in a protected area, do not take any dry wood from the ground because it can represent the habitat of some insects. remember the memories, on the retina or on the photo film;
- don’t break the stalactites or stalagmites in the caves, don’t break the protected plants, keep nature’s reserves and monuments intact; do not climb the monuments of nature;
- do not harass animals
- do not feed wild animals;
- do not carve the markings, do not twist the indicator arrows
- respect the people and places visited;
- help the one in difficulty;
- a group has a leader; a group does not split; the group adapts to the possibilities of the least prepared;
- don’t forget to drink water and eat; dehydration also brings lack of moisture;
- it is mandatory for any tourist, guide or group leader to strictly follow the advice and instructions of the mountain rescuers;
- the signaling code in case of danger must be known and learned by all mountain tourists;
5. Movement in the field
5.1 Hiking
For hiking in hard-to-reach terrain, the route covered is marked with certain signs – with paint on the rocks, piles of stones, bending over some bushes, hanging some characteristic objects on the lower branches of the trees – to be able to use them on the way back. Other characteristic objects – unusual stones, trees overturned – they are memorized and viewed from
the opposite direction to retain their image.
By itinerary is meant the direction established in the field for moving on foot, on skis, on snowshoes and on vehicles. If the movement is carried out by climbing or abseiling, the established direction is called the route. A mountain itinerary can be a path, a road, a road, a bridge or directly over ridges, valleys and slopes determined by certain landmarks.
5.1.1 Walking at high altitudes
From 2000 m above, is influenced by:
- rarefied and dry air;
- strong solar rays, rich in ultraviolet radiation;
- lack of water;
- strong currents;
- low temperature.
5.1.2 In order to reduce their effect on tourists, the following is required:
- a slow pace and great caution, to avoid unnecessary efforts – at higher altitudes the breathing is more accentuated;
- prevention and elimination of accidents that can be caused by avalanches of stones, cuts, etc. because evacuations are very difficult;
- saving water;
- the dumps should be made on slopes protected from wind and air currents;
- to avoid direct exposure of the head to the sun’s rays, the participants wear protective glasses.
5.1.3 Walking in low temperatures increases the effort, especially when climbing
In order to ensure the best travel conditions, the following is required:
- no part of the body should be tight, especially the wrists and extremities – fingers and toes should move in gloves, respectively in shoes;
- do not excessively tighten the straps of skis, snowshoes or poles, as well as those of to the backpack;
- dosage as an effort of walking and its execution as evenly as possible, in order to avoid sweating of the body, alternatively with its cooling;
- during breaks to wear a thicker coat;
- not to drink very cold water and not to eat snow; water is replaced with tea or coffee and drink in rare sips;
- the part openers in front of the column should be run as often as possible;
- not to sit down or remain motionless during short breaks, and to take long breaks, as much as possible, in houses, cabins, barns etc.;
5.1.4 Walking in high temperatures or strong sun is difficult.
At higher altitudes, although the air temperature is lower, the heat is more scorching due to ultraviolet radiation. under these conditions, sunstrokes of all degrees, fainting, profuse perspiration, skin irritations in heavily perspiring areas frequently occur. To perform the march in optimal conditions, it is necessary:
- to avoid trips between 11.00-14.00;
- while walking, the head and neck must be covered;
- as much as possible, walk through the forest or on ridges;
- it is recommended to replace water with unsweetened tea that is drunk in rare sips;
- breaks are chosen in shaded portions of land and, as far as possible, near springs;
- it is not recommended to drink water immediately after stopping, but before moving.
5.1.5 Walking in a blizzard is difficult, making breathing difficult, snow and ice dust enters through the openings of the equipment, whipping painfully especially the face and hands. The blizzard psychologically influences the morale of those untrained in winter walking or who do not have the appropriate equipment. Will and energy are required to the maximum. In order to carry out the walk in optimal conditions, the following is required:
- the movement should be continuous and should not be done on the side sheltered from the wind – avoiding eaves or cornice surprises;
- the number of breaks should be reduced, to avoid catching a cold;
- reducing distances and keeping the column as compact as possible;
- the continuous supervision of clients by the contractors so that no one is left behind and the detection of the first signs of frostbite;
- to cover the ears and nose, to avoid inhaling snow dust that can cause congestion;
- protecting eyes with glasses and hands with gloves and overgloves;
- consumption of consistent food supplements.
5.1.6 Travel speed. The uneven condition of the roads gives rise to difficulties in determining the travel speed. For the sections of the route on the slope, their inclination is taken into account, in order to reduce the speed accordingly both when going up and when going down. The average walking speed in the mountains is reduced by 30-40% compared to that which can be achieved in ordinary terrain.
5.1.7 The technique of moving with the help of cornering tools and ice axes. To move on steep slopes covered with hardened snow or ice, use ice axes and axes. insurance/self-insurance is carried out with an ice ax, pitons or ice screws. When not in use, the corners are preferably placed inside the rucksack in a hard or laminated canvas cover. The short axes can stay in the backpack, and the long ones are held in the hand.
5.2 Via Ferrata routes:
The via ferrata routes are mountain routes equipped along their entire length with metal structures, iron steps, metal ropes, pitons, suspension bridges etc., that allow people less experienced in the field of mountaineering to safely travel routes similar to those of mountaineering. The via ferrata routes are climbing routes and must be approached as such. The via ferrata routes can only be traveled with special equipment. The use of improvised equipment is prohibited.
The mandatory via ferrata equipment is composed of:
- Climbing harness
- Climbing helmet
- Via ferrata slider (set composed of 2 ladders, carabiners with wide opening and energy dissipator)
- additional, but not mandatory, spare tire and grippy gloves
Suitable footwear: it can be mountain footwear with a rigid or semi-rigid sole, depending on the general appearance of the route.
6. The role of the guide
The occupation of Mountain Guide takes place on the territory of Romania according to the new Occupational standard of 2019 and has the COR code 511311. In this standard the competences of the Mountain Guide are provided, which if we summarize in a few lines it shows that the mountain guide accompanies the clients in all mountain areas, in technical activities such as mountaineering, climbing, ice climbing, off-piste ski touring, winter or summer technical touring, regardless of difficulty and has the competence to train clients in all these activities. In other words, the Mountain Guide has the right to use technical equipment such as ropes, ice axes, harness, touring skis etc.
The mountain guide has skills in all the main mountain areas (hiking, rock climbing, mountaineering, skiing), but also in related ones, such as mountain navigation, rope and rescue maneuvers, climbing on artificial structures or canyoning. In addition, the mountain guide instructs, counsels and advises his clients in relation to the necessary techniques and the acquisition and use of equipment.
The mountain guide is up to date with all the news and innovations related to the techniques used and regularly participates in continuous professional development (CPD) modules, organized by the professional associations in the field.
The mountain guide is prepared to provide first aid in the event of an accident, being the most able to do so until the arrival of specialized services. In such a case, the guide first of all takes care of his clients, and then, if possible, he gives help to other injured people, without endangering his own person.
The mountain guide understands that mountain activities present a certain degree of risk and takes all measures for its correct management. He makes sure that the risks are correctly understood by the client.
The mountain guide makes all the decisions regarding the safety of the group and, when his decisions consist of modifying or canceling a tour, he explains his reasons to the clients.
The mountain guide respects and protects the environment and is a positive example for those around him.
7. EQUIPMENT RENTAL CONDITIONS
The rented equipment will be delivered/picked up by the organizer before the start of the shift and will be returned at the end of it or if the organizer determines. The rented equipment will be returned at the time and date established by the rental contract.
In case of delay without prior notification, a penalty fee of 100 RON plus the value corresponding to the tariff for the exceeded period may apply.
The rented equipment is intended for leisure, not for commercial use. During the rental period, the tenant is not allowed to intervene on the technical condition or adjustments of the rented equipment without the consent of the organizer.
The reservation of the equipment is done by signing up for the tour. The rented equipment will be used exclusively by the customer, or the customer group of which he is a part. The customer is obliged to use the rented equipment under normal operating conditions and to avoid partial or total damage to the rented equipment. Otherwise, he will bear the value of the missing or destroyed equipment (subassembly). The customer is fully responsible for the use of the equipment and the risks that may arise during the rental period.
Our company is not responsible for the injury, accident, or damage in any way to the client or a third person. The customer is fully responsible for damages of any nature (material, moral, physical, etc.) caused to a third party during the validity period of the contract. In the event of any defect occurring during the performance of the contract, the customer has the obligation to notify the ETTA Mundo team.
